Firm Prevails against City of Los Angeles in Monell Claim

  • Client Win

The Firm prevailed on a motion for summary judgment against the City of Los Angeles for an unconstitutional custom or practice pursuant to Monell.

The Firm represented a mother who had property confiscated by the Los Angeles Police Department without receipt of proper documentation during a parole compliance search regarding her child, who lived with her at that time. Through diligent deposition examination, the Firm was able to get on record the testimony of a LAPD officer conceding to the absence of a policy pertaining to asset forfeiture releases. The Firm’s Monell Claim against the City of Los Angeles was then granted on summary judgment by a United States district judge.
