| State and federal firearms and weapons laws have become extremely tough and complicated. Although the Second Amendment to the United States Constitution gives all citizens the right to bear arms, there are dozens of rules and regulations that apply that make almost every case unique. For example, there are certain categories of people who are prohibited from bearing arms, including individuals with prior felony convictions and non-citizens. There are also many places where no one is permitted to carry a firearm without a specialized permit, such as on a school campus, in a government building, or at an airport. Separately, even if you are a prohibited person or carry a weapon in a prohibited place, it is only a crime for you to do so if your possession of the weapon was done “knowingly.” Merely carrying a firearm or weapon without the required knowledge is not a crime. |
